Terms & Conditions — Mocean Surf Peniche

1. Service Provider Identification

Mocean Surf Peniche is a registered maritime‑tourism operator and complies with all legal requirements, including mandatory insurance coverage.

2. Insurance

In accordance with Portuguese law and RNAAT regulations, Mocean Surf Peniche maintains:

  • Personal Accident Insurance

  • Civil Liability Insurance

These insurances cover participants during activities provided by the school. Coverage details are available upon request.

 

3. Acceptance of Terms

By booking or participating in any surf, surfskate, rental, or related activity provided by Mocean Surf Peniche, the client acknowledges and accepts these Terms & Conditions.

 

4. Assumption of Risk

Surfing and surfskating involve inherent risks, including the possibility of injury.

By participating, the client declares that:

  • They understand the risks involved

  • They are physically and medically fit to participate

  • They accept full responsibility for their participation

Mocean Surf Peniche is not responsible for injuries, accidents, or damages that occur during lessons or activities, except where liability is legally mandatory.

5. Safety Rules & Client Conduct

Clients must follow all instructions given by instructors at all times.

Mocean Surf Peniche may exclude any participant from an activity, without refund, if:

  • They fail to follow safety instructions

  • Their behaviour endangers themselves or others

  • They disrupt the lesson

  • They are suspected of being under the influence of alcohol or drugs

Minimum age requirements may apply depending on the activity and sea conditions.

6. Equipment Use

Mocean Surf Peniche provides equipment in good condition. The client agrees to:

  • Use the equipment responsibly

  • Return it in the same condition

  • Accept financial responsibility for any loss or damage caused by misuse or negligence

7. Weather & Ocean Conditions

Surfing depends on natural conditions that cannot be controlled.

Mocean Surf Peniche may:

  • Change the schedule

  • Change the location

  • Modify the activity

  • Replace the activity with a suitable alternative

No refunds are issued due to:

  • Poor surf conditions

  • Conditions not matching client expectations

  • Lesson performance affected by weather or ocean conditions

If conditions are unsafe, Mocean Surf Peniche will reschedule the lesson.

8. Cancellations & Refunds

Client Cancellations

  • Cancellations made more than 48 hours before the lesson: free rescheduling.

  • Cancellations made less than 48 hours before the lesson: no refund.

  • No‑shows: no refund.

Provider Cancellations

If Mocean Surf Peniche cancels due to safety or operational reasons, the client may choose:

  • A rescheduled lesson

  • A credit for future use

Refunds are issued only when rescheduling is not possible.

9. Medical Conditions

The client declares that they do not suffer from any medical condition that may affect their ability to safely participate in surf or surfskate lessons.

Any condition must be communicated to the instructor before the activity.

10. Liability Waiver

Before participating in lessons or renting equipment, clients must sign a liability waiver as required by Portuguese law and RNAAT regulations.

11. Photography & Video

Mocean Surf Peniche may take photos or videos during lessons for:

  • Social media

  • Website content

  • Promotional materials

If the client does not consent to being photographed or filmed, they must inform the instructor before the lesson begins.

12. Monthly Academy Membership

To join the Academy monthly plan, a €50 deposit is required. This deposit is applied to the second month of membership.

13. Complaints & Consumer Rights

In accordance with Portuguese law:

  • Clients may submit complaints through the Livro de Reclamações Eletrónico.

  • The competent Alternative Dispute Resolution entity is:

14. Jurisdiction

These Terms & Conditions are governed by Portuguese law. Any disputes will be resolved in the courts of Portugal.
